HappierBifolds Terms and Conditions of Sale 8 Feb 2021

Please note that before placing an order you will be asked to agree to these Terms. If you refuse to accept these Terms, you will not be able to order from our website (“site”). We recommend you should keep a copy of these Terms for future reference.

Please ensure you have read our security & privacy policy fully before using the site and placing your order.

Entire Agreement

These Terms contain the whole agreement between the parties who confirm that they have not entered into the Contract in reliance on any representations that are not expressly incorporated in these Terms. These Terms apply to the Contract to the exclusion of any other terms that You may seek to impose or incorporate or which are implied by trade, custom, practice or course of dealing. You acknowledge that by entering into this Contract, You have not relied on any statement, promise or representation made or given by or on behalf of the Company which is not set out in the Contract.

Products & service

Happierbifolds.com offers a range of supply only products.  Installation services do not form part of the price or offer. The site allows you to enter your own measurements to gain a quote via our individual product designers.  You are entirely responsible for the sizes and specification submitted to us.

The product designers are maintained and regularly checked, but from time to time the information may be incomplete or out of date, illustrations are shown for information purposes and may differ from actual product.  We reserve the right to change design options and prices in the product designers and remove access to the product designers without prior notice. On the rare event that our product designers quote a product which is outside of our recommended product range, we will contact you to offer an alternative or a full refund.

Prices & logistic charges

All prices quoted by our product designers are exclusive of VAT, VAT will be added at the prevailing rate at the time of sale.  Delivery is automatically calculated according to your post code.  For deliveries outside of our standard post code area please contact us for a quotation prior to you placing an order.  The logistics charge will be added to the total order value upon entering the valid postcode of the proposed delivery address and placing your order.  If a postcode is entered that is not the postcode of the proposed delivery, we retain the right to charge for logistics charges for the correct delivery property postcode if applicable.

We reserve the right to change the prices of our products in the product designers and remove access to the product designers without prior notice. Prices are calculated dynamically and are only valid on the date and time that the quote is given, after that the price is no longer valid and the products would need to be redesigned via our product designers again or requoted by us. We reserve the right to cancel all quotes at any time.

Our site contains a large number of products and variations. It is always possible that, despite our reasonable efforts, some products may be incorrectly priced. If we discover an error in prices quoted to you, we will contact you to inform you of this error and we will give you the option of continuing with the quote at the correct price or cancelling with a full refund if any monies have been taken. If we are unable to contact you using the contact details provided during the process, we will treat the order as cancelled and notify you in writing.

Ordering bespoke products

All our products are bespoke and made especially for you; once the order has entered production there is no opportunity to cancel.  Goods are manufactured according to the tolerances and guidelines provided by the manufacturer.

We do our best to communicate all product and service details before you confirm your order, but if you do require more information please contact our sales office.

All payment, order amends / cancellations and complaint processes specifically for bespoke products are detailed in our terms and conditions and do not affect your statutory rights.

We reserve the right to cancel any order within 10 days of placement. If the contract is cancelled by HappierBifods, all payments will be refunded but we will have no further liability.

Refunds will be confirmed in writing within 2 working days and paid within the following 10 days.


Payment terms are 100% with order, we must be in receipt of funds prior to manufacture.

Payment can be made via our web site or alternatively you can contact our sales office directly to make payment over the phone, you will be charged upon payment. Cash or cheques are not accepted.


All our delivery dates are quoted in good faith and whilst every reasonable effort shall be made to keep to this, this is not guaranteed. In the rare event that we need to rearrange this date, we shall not be liable for any losses, costs, damages or expenses incurred by you or any other person or company as a result of us rearranging the agreed delivery date.  The company will not deliver to unattended premises.

The quoted delivery price allows for standard kerbside delivery.  This means that the driver will park up outside your premises and it’s then your responsibility to unload your goods from the truck.  While it is possible that you get a helpful driver who may be inclined to help you unload your goods, it is not their job. Your driver is under no obligation to help you unload your goods (as they won’t be insured if they are injured or something goes wrong). This is why we recommend that you have a friend or two on hand to help you remove your goods from the truck.  You know your shipment and delivery premises better than we do so if you have any special requirements then you must let us know in writing at the time that you place your order.

The Company will not accept Orders under penalty of late delivery and shall not be liable for delay in delivery of Goods. Time for delivery shall not be of the essence of the Contract.

Guarantee & liability

Every item that we sell is carefully inspected prior to despatch and wrapped adequately to provide protection during transportation.  All damage / defects must be photographed and reported in writing on the day of delivery, no later than one hour after delivery and must be prior to installation.

Guarantee terms: frames 10 years, glass 10 years, hardware 1 year.  Just fill in and return your registration card within one month of delivery to commence your cover.  The Guarantee does not cover wear and tear, accidental damage, neglect, abused / misused or altered products, products cleaned with incorrect cleaning products, incidental or consequential damage or losses.

Please notify where the frames are to be installed within hazardous environmental conditions, such as marine, industrial or swimming pools as this will reduce the guarantee period which will be subject to prior agreement.

Goods supplied but not manufactured by the Company are sold subject to the conditions of sale of the manufacturers of those goods and the Company will pass on the benefit of the suppliers’ guarantees to You where possible. However, in the event of any failure by the manufacturer, for whatever reason, to meet any liability, the Company shall be under no liability to You in that respect.

Our sole liability is to provide replacement parts and will not be liable for fitting costs or any consequential loss. We accept no liability for the following:

  • Condensation which may form on the product
  • Damage attributable to the failure of foundations or structure
  • Damage due to accident, storm, flood, negligence, misuse or unauthorised acts of a third party
  • Any imperfection inherent in the glass making process
  • Failure to adhere to our care and maintenance instructions
  • Any damage caused to your property, including redecoration required, unless it comes as a result of our negligence
  • Loss or damage caused as a result of pre-existing structural defects
  • Any indirect or consequential loss
  • Any claims for consequential compensation
  • Damage to glass, frames and hardware caused by products not being installed strictly in accordance with the manufacturers guidelines.

Viewing glass units, frames and hardware for scratches on the outer faces of the panes must be carried out on the date of delivery, no later than 1 hour after delivery and must be done prior to installation.  When measuring all aspects of quality of glass, please follow the below Glass and Glazing Federation Guidelines:

  • Stand in the room no less than 2 metres away from the IGU and look directly through them.
  • For toughened, laminated or coated glasses, stand no less than 3 meters away.
  • Do so in natural daylight, but not directly towards the sun and with no visible moisture on the surface of the glass.
  • Where it is not possible to stand at the right distance then stand as far away as you can from the IGU.
  • Exclude 50mm wide band around edge of the glass from the check.
  • Glass must be viewed at 90 degrees to the window.

Except in respect of death or personal injury caused by the Company’s negligence or liability for defective products under the Consumer Protection Act 1987, the Company shall not be liable to You by reason of any representation (unless fraudulent) or any implied warranty, condition or other term or any duty at common law or under the express terms of the Contract whether in contract, tort, breach of statutory duty or otherwise for loss of profit or for any indirect, special or consequential loss or damage, costs, expenses or other claims for compensation whatsoever (including any losses that may result from the Company’s deliberate repudiatory breach of the Contract) or whether caused by the negligence of the Company, its employees, agents or otherwise which arise out of or in connection with the supply of the Goods including any delay in supplying or failure to supply the Goods in accordance with the Contract or at all or their use or resale by You, and the entire liability of the Company under or in connection with the Contract shall not exceed the Price in respect of the Goods the subject of the claim.

All guarantee claims must be made in writing, with supporting imagery where needed directly to us. From there we will conduct a review. We will supply replacement parts within the stated guarantee period in accordance with the terms.

Please ensure you follow our care and maintenance instructions carefully.

Complaints & claims procedure

Any complaint or claim should be made directly to happierwindows.com, the claim itself should be in writing setting out the delivery date, address of the property and giving a brief explanation of the problem along with supporting photos. Please support this letter with full contact details and your proof of purchase, without these we cannot handle your enquiry. All complaints will be responded to within 7 working days.

Governing Law & Jurisdiction This agreement shall be governed by and construed in accordance with the law of England and Wales and each party agrees to submit to the jurisdiction of the courts of England and Wales. Any dispute arising in connection with these Terms shall be resolved according to English law in the Bristol County Court.
